1. Agreement to Terms

By downloading, installing, or using AI Notes Taker ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Description of Service

AI Notes Taker is a macOS application that records audio, transcribes speech to text on-device using WhisperKit, and optionally summarizes transcripts using AI. The App offers both free and paid (Pro) tiers.

• Free tier: Audio recording and on-device transcription.
• Pro tier: AI-powered summarization of transcripts via a cloud-based API, activated with a license key obtained through a paid subscription.

3. Subscriptions and Payments

Pro subscriptions are processed through our payment partner (Paddle or Ko-fi). By subscribing, you agree to the following:

• Subscriptions are billed on a recurring monthly basis.
• You will receive a license key via email upon successful payment.
• Your license is valid for the duration of the current billing period.
• You may cancel your subscription at any time. Access continues until the end of the current billing period.
• Prices may change with reasonable notice.

4. Refund Policy

We want you to be satisfied with your purchase. If you are not happy with the Pro subscription:

• You may request a full refund within 14 days of your initial purchase.
• Refund requests after 14 days will be considered on a case-by-case basis.
• To request a refund, contact us at support@aitranscript.app.
• Refunds are processed through the original payment method.

5. User Responsibilities

• You are responsible for ensuring you have the right to record any audio you capture with the App.
• You must comply with all applicable laws regarding audio recording and consent in your jurisdiction.
• You must not share, redistribute, or resell your license key.
• You must not attempt to reverse engineer, decompile, or tamper with the App or its API.

6. Privacy and Data

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. Key points:

• Audio transcription is performed entirely on your device. No audio data leaves your Mac.
• If you use the Pro summarization feature, your transcript text is sent to our server for processing and is not stored after the response is returned.
• We store your email address and license key for subscription management.

7. Intellectual Property

The App, its design, code, and branding are the property of the developer. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or business purposes. You do not acquire any ownership rights.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that transcription or summarization results will be accurate. AI-generated summaries should be reviewed before relying on them for important decisions.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the App, including but not limited to loss of data, inaccurate transcriptions, or missed information.

10. Termination

We reserve the right to terminate or suspend your license if you violate these terms. Upon termination, your license key will be deactivated and you must stop using Pro features.

11. Changes to Terms

We may update these terms from time to time. The updated version will be posted on this page with a revised date. Continued use of the App after changes constitutes acceptance of the new terms.
